General conditions of sale of real estate


PKP S.A. sells properties:

  • by tender,
  • in non-tender procedures,
  • by way of negotiations,
  • pursuant to Article 151 and 231 of the Civil Code,
  • by way of exchange of properties.

Sale of properties in a tender procedure:

PKP S.A. conducts an oral open tender in the form of bidding and a written open tender (tender offers). The tenders are directed at legal persons, as well as entities without legal personality. PKP S.A. announces tenders in a nationwide newspaper:

  • 30 days prior to the date of the tender, if the initial price of the property exceeds 5 thousand Euro,
  • 60 days prior to the date of the tender, if the initial price amounts to at least 500 thousand Euro; the information is announced once again 30 days prior to the date of the tender.

Regardless of the initial price of the property, the tender announcement is published on the website of PKP S.A.
The company can also sell properties by way of negotiations. In this case, the announcement is published in a nationwide newspaper at least 21 days prior to the date of placing offers. The offers are to be made 7 days prior to the determined date of negotiations.

Detailed rules concerning the sale of properties and tender procedures are stipulated in the provisions of the Act of 8 September 2000 on the commercialisation, restructuring and privatisation of the “Polskie Koleje Państwowe” state enterprise (Journal of Laws No. 84 item 948, as amended), the Act of 21 August 1997 on real property management (consolidated text, Journal of Laws of 2000 No. 46 item 543, as amended), the Regulation of the Minister of Infrastructure of 11 September 2009 on the determination of mode of organising tenders and negotiations for the disposal of fixed assets by PKP S.A. (Journal of Laws No. 155 item 1231), and internal regulations.
